This Privacy Policy applies to Intoit services (the “Platform”), which include Intoit apps, websites, software, and related services accessed via any platform or device that links to this Privacy Policy. The Platform is provided and controlled by Intoit Corp. (“Intoit,” “we,” or “us”). We continuously strive to protect your privacy and provide a digitally safe platform. This Privacy Policy explains how we collect, use, share, and otherwise process the personal information of users and individuals aged 13 and over in connection with our platform. Please refer to our separate Children's Privacy Policy for details about how we collect, use, share, and otherwise process users' personal information under age 13 (“Children”).

Capitalized terms not defined in this Privacy Policy have the meaning given in the Terms of Service below.

 

What Information We Collect

We may collect information from and about you, including information that you enter into the platform, information from other sources, and automatically collected information for the use of our in-house recommendation systems.

Information You Provide Us

At Intoit, we value your privacy and are committed to protecting your personal information. When you engage with our Platform, whether by creating an account, uploading content, contacting us directly, or utilizing any other features, you may be required to provide certain information. Below, we outline the types of information we may collect:

  1. Account and Profile Information: This includes details such as your name, age, username, password, language, email address, phone number, social media account information, and profile image.

  2. User-Generated Content: When you create or upload content on our Platform, such as comments, photographs, text, hashtags, and virtual items, we collect this User Content and its associated metadata, which includes information about when, where, and by whom the content was created. Please note that even if you are not a user, information about you may appear in User Content created or published by other users on the Platform.

  3. Messages: If you use the messaging functionalities of our Platform, the information you provide while composing, sending, or receiving messages will be collected. It's important to be aware that any messages you send to other users will be accessible by those users, and we cannot be held responsible for how they use or share such messages.

  4. Clipboard Information: With your explicit permission, we may access and collect information from your device's clipboard, including text and images. For example, if you choose to share information with a third-party platform or paste content from the clipboard onto our Platform, we will access this stored information solely for the purpose of fulfilling your request.

  5. Purchase Information: When necessary for payment purposes, we may collect payment card numbers or other third-party payment information (such as PayPal) along with billing and shipping addresses.

  6. Phone and Social Network Contacts: With your permission, we may access and collect information from your phone contacts to help you find and connect with other users on our Platform. This may include names, phone numbers, and email addresses. Similarly, if you choose to find other users through your social network contacts, we will collect your public profile information as well as the names and profiles of your social network contacts.

  7. Choices and Communication Preferences: We collect information about your preferences and communication choices to ensure that we provide you with the most relevant and personalized experience on our Platform.

  8. Verification Information: In certain cases, we may require additional information, such as proof of identity or age, to verify and secure your account.

  9. Correspondence: Any information you include in your correspondence with us, including when you reach out for support, will be collected and stored.

  10. Survey Participation and Challenge/Event/Contest Information: If you choose to participate in surveys, challenges, research studies, promotions, marketing campaigns, events, or contests, we may collect information such as your gender, age, likeness, and preferences as necessary for these activities.

Please note that we are committed to safeguarding your information and will only use it in accordance with our Privacy Policy.

Information From Other Sources

In addition to the information directly provided by you, we may also receive certain information from other sources as described in this Privacy Policy. These sources may include:

  1. Third-Party Service Integration: If you choose to sign up or log in to our Platform using a third-party service like Spotify, Apple Music, or Google, or if you link your Intoit account to a third-party service, we may collect information from that service. This may include your public profile information (such as a nickname), email address, and contact list.

  2. Information Provided by Others: We may receive information about you from other individuals or users of the Platform. This may occur when you are mentioned or included in User Content, direct messages, complaints, appeals, requests, or feedback submitted to us. Furthermore, if someone provides us with your contact information, we may collect and process that information.

  3. Publicly Available Information: We may gather information about you from publicly available sources, ensuring compliance with applicable laws and regulations.

Automatically Collected Information

We automatically collect certain information from you when you use the Platform, including internet or other network activity information such as your IP address, geolocation-related data, unique device identifiers, browsing and search history (including content you have viewed in the Platform), and Cookies to enable our location-based features (events).

  • Usage Information. We collect information regarding your use of the Platform and any other User Content that you generate through or upload to our Platform. 

  • Location Data. We collect information about your approximate location, including location information based on your SIM card and/or IP address. In addition, we collect location information (such as bars, clubs, or other points of interest) if you add the location information to your User Content. We may also collect precise location data (such as GPS) with your permission.

  • Metadata. When you upload or create User Content, you automatically upload specific metadata that is connected to the User Content. Metadata describes other data and provides information about your User Content that will not always be evident to the viewer. For example, in connection with your User Content, the metadata can describe how, when, where, and by whom the piece of User Content was created, collected, or modified and how that content is formatted. It also includes information, such as your account name, enabling other users to trace the User Content to your user account. Additionally, the metadata contains data you choose to provide with your User Content, e.g., any hashtags used to mark keywords to the video and captions.

  • Cookies. We and our service providers and business partners use cookies and other similar technologies (e.g., web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze how you use the Platform, including which pages you view most often and how you interact with content, enhance your experience using the Platform, improve the Platform, provide you with recommendations, and measure the effectiveness of recommendations and other content. We also use Cookies to promote the Platform on different platforms and websites. Cookies enable the Platform to provide certain features and functionality. Web beacons are very small images or small pieces of data embedded in images, also known as “pixel tags” or “clear GIFs,” that can recognize Cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. To learn how to disable certain Cookies, see the “Your Choices” section below.

We may link your contact or account information with your activity on and off our Platform across all your devices using your email or other log-in or device information. We may use this information to display advertisements on our Platform tailored to your interests, preferences, and characteristics.

We are not responsible for the privacy practices of our service providers and business partners, and the information practices of these service providers and business partners are not covered by this Privacy Policy.

We may aggregate or de-identify the information described above. Aggregated or de-identified data is not subject to this Privacy Policy.

How We Use Your Information

The information we collect from you serves various purposes aimed at improving, supporting, and administering the Platform, enabling you to utilize its functionalities, and ensuring compliance with our Terms of Service. Additionally, we may utilize your information for the following:

  1. Fulfillment of Requests and Internal Operations: We use the collected information to fulfill your requests for content, venues, Platform functionality, and support. It also aids us in conducting internal operations, such as troubleshooting, data analysis, testing, research, statistics, and surveys. Furthermore, we may solicit your feedback on the Platform.

  2. Customization of Content: We personalize the content you see on the Platform based on factors like your chosen country settings, preferences, and interactions. This enables us to provide you with tailored services and recommend content similar to what you have liked or engaged with.

  3. Promotional Activities: We may use your information to send promotional materials on behalf of ourselves, our affiliates, and trusted third parties.

  4. Platform Improvement and Product Development: The information gathered is utilized to enhance and develop the Platform, including conducting product development initiatives.

  5. Advertising Effectiveness and Targeting: We measure and assess the effectiveness of the advertisements served on the Platform to you and others. This allows us to deliver targeted advertising based on your interests and preferences.

  6. Suggestions and Customized Ad Experience: We provide suggestions and deliver a personalized ad experience based on the information we have about you.

  7. Social Functions Support: The information collected supports the social functions of the Platform, such as enabling connections between users through features like "Find Friends." It also facilitates the sharing, downloading, and interaction with User Content posted on the Platform.

  8. User Content in Advertising and Marketing: User Content may be used as part of our advertising and marketing campaigns to promote the Platform.

  9. Understanding Platform Usage: We analyze your usage patterns on the Platform, including across multiple devices, to gain insights into how you utilize the Platform.

  10. Additional Information Inference: We may infer additional information about you, such as your age, gender, and interests, based on the collected data.

  11. Detection of Abuse, Fraud, and Illegal Activity: The information is employed to identify and detect instances of abuse, fraud, and illegal activities on the Platform.

  12. Safety and Security: We promote the safety and security of the Platform by scanning, analyzing, and reviewing User Content, messages, and associated metadata for violations of our Terms of Service, Community Guidelines, and other policies.

  13. Identity Verification: Your information may be used to verify your identity when utilizing specific features, such as verified accounts or applying for a Creator Account. This ensures compliance with age requirements and other necessary verifications.

  14. Communication: We use your information to communicate with you, including notifying you about changes in our services.

  15. Contest and Promotion Announcements: If permitted by the promotion rules, we may announce you as a winner of contests or promotions and send you applicable prizes.

  16. Enforcement of Policies: We utilize the information to enforce our Terms of Service, Community Guidelines, and other conditions and policies.

  17. Location-Based Services: Subject to your permissions, we provide location-based services, including advertising and personalized content, based on your geographical location.

  18. Technology Training and Improvement: The information is utilized to train and improve our technology, such as machine learning models and algorithms.

  19. Data Combination: We may combine all the information collected or received about you for the aforementioned purposes.

  20. Sales, Promotion, and User Support: The collected information supports sales, promotions, and purchases of goods and services. It also aids in providing user support.

  21. Other Purposes: In cases where we disclose specific purposes at the time of collecting your information or with your consent, we may utilize the data for those stated purposes

How We Share Your Information

We are committed to maintaining your trust, and while Intoit does not sell your personal information or share your personal information with third parties for purposes of cross-context behavioral advertising where restricted by applicable law, we want you to understand when and with whom we may share the Information We Collect for business purposes.

Service Providers and Business Partners

We share the categories of personal information listed above with service providers and business partners to help us perform business operations and for business purposes, including research, payment processing and transaction fulfillment, database maintenance, administering contests and special offers, technology services, deliveries, sending communications, advertising, and marketing services, analytics, measurement, data storage and hosting, disaster recovery, search engine optimization, and data processing. These service providers and business partners may include:

  • Payment processors and transaction fulfillment providers who may receive the Information You Provide, Information From Other Sources, and Automatically Collected Information but who do not receive your message data, including, in particular, the following third-party payment provider/processor: PayPal (https://www.paypal.com/us/webapps/mpp/ua/privacy-full)

  • Customer and technical support providers, who may receive the Information You Provide, Information From Other Sources, and Automatically Collected Information.

  • Researchers may receive the Information You Provide, Information From Other Sources, and Automatically Collected Information but would not receive your payment information or message data.

  • Advertising, marketing, and analytics vendors may receive the Information You Provide, Information From Other Sources, and Automatically Collected Information but would not receive your payment information or message data.

In Connection with a Sale, Merger, or Other Business Transfer

We may share all of the Information We Collect in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sales, or in the unlikely event of bankruptcy.

For Legal Reasons

We may disclose any of the Information We Collect to respond to potential subpoenas, court orders, legal process, law enforcement requests, legal claims, or government inquiries, and to protect and defend the rights, interests, safety, and security of the Platform, our affiliates, users, or the public. We may also share any of the Information We Collect to enforce any terms applicable to the Platform, to exercise or defend any legal claims, and comply with any applicable law. 

With Your Consent

We may share your information for other purposes pursuant to your consent or direction.

We partner with third-party services (such as Spotify, Apple Music, and Google) to offer you a seamless sign-up, log-in, and content-sharing experience. We may share information about you with these third-party services if you use these features. For example, the services may receive information about your activity on the Platform and may notify your connections on the third-party services about your use of the Platform in accordance with their privacy policies. If you choose to allow a third-party service to access your account, we will share certain information about you with the third party. Depending on the permissions you grant, the third party may be able to obtain your account information and other information you choose to provide.

If you choose to engage in public activities on the Platform, you should know that any information you share may be read, collected, or used by other users. You should use caution in disclosing personal information while using the Platform. We are not responsible for the data you choose to submit.

Your Rights

To exercise your rights regarding the information we have collected about you, you can submit a request through the Contact Us section of the platform. You have the right to know, access, correct, or delete your personal information. If you disagree with any decisions made regarding your request, you can follow the instructions provided in the communication you receive from us to appeal the decision.

Additionally, you have the option to update your account information directly through the in-app settings. You can also request a copy of your Intoit data or request to deactivate or delete your account.

When exercising your right to know, you have the right to know the specific personal information we have collected about you. This includes the categories of sources from which the information is collected, the business or commercial purpose for collecting or sharing the information, the categories of third parties with whom we share the information, and the specific pieces of personal information we have collected.

We do not discriminate against you based on your exercise of privacy rights.

If you are entitled to submit a request through an authorized agent, you can do so by providing evidence of the agent's authority, such as power of attorney or valid written authorization. We will respond to your request in accordance with applicable law and after proper verification, which may include asking you to send the request from the email address associated with your account or providing information to verify your account.

While we may collect and use sensitive personal information, we only process such information to provide the Platform and within the exemptions allowed by applicable law. For example, we may process financial information to fulfill your requested goods or services or process your driver's license number to verify your identity.

Your Choices

  • You may be able to control some of the Information We Collect through your device browser settings to refuse or disable Cookies. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of Cookies. In addition, your choice to disable Cookies is specific to the particular browser or device that you are using when you disable Cookies, so you may need to separately disable Cookies for each type of browser or device. If you choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to you. Without this information, we are not able to provide you with all of the requested services.

  • You can navigate to "Sponsored Posts" in your in-app settings to opt out of targeted advertising based on personal information about your activity on nonaffiliated apps and websites.

  • Your device may have controls that determine what Information We Collect. For example, you can control whether we can collect your mobile advertising identifier for advertising through your device settings.

  • You can opt out of marketing or advertising emails by using the “unsubscribe” link or mechanism noted in marketing or advertising emails.

  • If you previously chose to share precise location information, you can prevent your device from sharing precise location information (e.g., GPS location information) with the Platform at any time through your device’s operating system settings.

  • If you have registered for an account, you may access, review, and update certain personal information that you have provided to us by logging into your account and using available features and functionalities.

  • Some browsers transmit “do-not-track” signals to websites. Because of differences in how browsers incorporate and activate this feature, we currently do not take action in response to these signals.

Data Security and Retention

We take reasonable measures to protect your information from unauthorized access, disclosure, alteration, or destruction. However, it's important to understand that no data storage system or transmission over the Internet can guarantee complete security. While we implement security measures, we cannot ensure the security of information collected by third parties, and we are not responsible for the security of such information.

We retain information for the duration necessary to provide the Platform and fulfill the purposes outlined in this Privacy Policy. We may also retain information to comply with contractual and legal obligations, protect our legitimate business interests (such as improving and developing the Platform, ensuring its safety and security, and defending against legal claims), and for other necessary purposes.

The retention periods vary depending on factors like the type of information and the purposes for which it is used. For example, if you have an account with us, we retain your profile information for as long as your account remains active. In the event of a violation of our Terms of Service, Community Guidelines, or other policies, we may remove your profile immediately but retain other relevant information for processing the violation.

Intoit may store and process your data on servers or data centers located outside of the United States. Additionally, when sharing your data with other entities as described in this Privacy Policy, it's possible that they may be located outside of the United States.

Children and Teens

The privacy of Children is important to us. We do not provide an experience for Children under the age of 13.

The Platform is not intended for Children. If we become aware that personal information has been collected on the Platform from a Child, we will delete this information and terminate the Child’s account. If you believe there is a user who is below the age of 13, please contact us.

Other Rights

Sharing for Direct Marketing Purposes (Shine the Light)

If you are a California resident, once a calendar year, you may be entitled to obtain information about personal information that we shared, if any, with other businesses for their own direct marketing uses. To submit a request, contact us.

Content Removal for Users Under 18

Users of the Platform who are California residents and are under 18 years of age may request and obtain the removal of User Content they posted by contacting us. All requests must provide a description of the User Content you want to be removed and information reasonably sufficient to allow us to locate that User Content. We do not accept California Removal Requests via postal mail, telephone, or facsimile. We may not be able to respond if you do not provide adequate information. Please note that your request does not ensure the complete or comprehensive removal of the material. For example, User Content you posted may be republished or reposted by another user.

Privacy Policy Updates

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will notify you by updating the “Last Updated” date at the top of the new Privacy Policy, posting the new Privacy Policy, or providing any other notice required by applicable law. We recommend you review the Privacy Policy each time you visit the Platform to stay informed of our privacy practices.

1. User Relationship

Welcome to Intoit (the “Platform”), which is provided by Intoit Corp. in the United States (collectively, such entities will be referred to as “Intoit," “we,” or “us”).

You are reading the terms of service (the “Terms”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform and our related websites, services, applications, products and content (collectively, the “Services”). Access to certain Services or features of the Services (such as, by way of example and not limitation, the ability to submit or share User Content (defined below)) may be subject to age restrictions and not available to all users of the Services. Our Services are provided for private, non-commercial use. For purposes of these Terms, “you” and “your” means you as the user of the Services.

The Terms form a legally binding agreement between you and us. Please take the time to read them carefully. If you are under age of 18, you may only use the Services with the consent of your parent or legal guardian. Please be sure your parent or legal guardian has reviewed and discussed these Terms with you.

ARBITRATION NOTICE FOR USERS IN THE UNITED STATES: THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND A WAIVER OF RIGHTS TO BRING A CLASS ACTION AGAINST US. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT ARBITRATION CLAUSE, YOU AND INTOIT AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND INTOIT WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

2. Accepting the Terms

By accessing or using our Services, you confirm that you can form a binding contract with Intoit, that you accept these Terms and that you agree to comply with them. Your access to and use of our Services is also subject to our Privacy Policy and Platform Guidelines, the terms of which can be found directly on the Platform, or where the Platform is made available for download, on your mobile device’s applicable app store, and are incorporated herein by reference. By using the Services, you consent to the terms of the Privacy Policy.

If you are accessing or using the Services on behalf of a business or entity, then (a) “you” and “your” includes you and that business or entity, (b) you represent and warrant that you are an authorized representative of the business or entity with the authority to bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf, and (c) your business or entity is legally and financially responsible for your access or use of the Services as well as for the access or use of your account by others affiliated with your entity, including any employees, agents or contractors.

You can accept the Terms by accessing or using our Services. You understand and agree that we will treat your access or use of the Services as acceptance of the Terms from that point onwards.

You should print off or save a local copy of the Terms for your records.

3. Changes to the Terms

We occasionally change these Terms, for instance, when we update our functionality, when we combine multiple apps or services operated by us or our affiliates into a single combined service or app, or when there are regulatory changes. We will use commercially reasonable efforts to generally notify all users of any material changes to these Terms, such as through a notice on our Platform; however, you should look at the Terms regularly to check for such changes. We will also update the “Last Updated” date at the top of these Terms, which reflects the effective date of such Terms. Your continued access or use of the Services after the date of the new Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop accessing or using the Services.

4. Your Account with Us

n order to access and use certain Services, you are required to create an account with us. When creating your account, it is important to provide accurate and up-to-date information. You are responsible for maintaining and updating your account details and other provided information to ensure its accuracy and completeness.

Keeping your account password confidential and not disclosing it to any third party is crucial. If you become aware or suspect that your password has been compromised or that a third party has accessed your account, it is important to notify us immediately.

You acknowledge and agree that you are solely responsible, both to us and others, for all activities that occur under your account.

We reserve the right to disable your user account at any time, including situations where you have failed to comply with the provisions outlined in these Terms. Additionally, we may take such action if activities conducted on your account, in our sole discretion, may cause damage to or disrupt the Services, infringe upon or violate the rights of any third party, or contravene any applicable laws or regulations.

If you decide to discontinue using our Services and wish to have your account deleted, please contact us at [contact information]. We will assist you and guide you through the account deletion process. It is important to note that once your account is deleted, it cannot be reactivated, and any content or information you have added to your account will be permanently inaccessible and irretrievable.

5. Your Access to and Use of Our Services

Your access to and use of the Services are subject to these Terms as well as applicable laws and regulations. The following actions are prohibited:

  • Accessing or using the Services if you are not legally competent to agree to these Terms or if you are not authorized by your parent or legal guardian.

  • Unauthorized copying, modifying, adapting, translating, reverse engineering, disassembling, decompiling, or creating derivative works of the Services or any included content.

  • Distributing, licensing, transferring, or selling the Services or any derivative works.

  • Using the Services for commercial purposes or performing commercial solicitation without our express written consent.

  • Using the Services for unauthorized purposes, including unauthorized commercial advertising, solicitation, or spamming.

  • Interfering with the proper functioning of the Services, disrupting our website or connected networks, or bypassing any access restrictions.

  • Incorporating the Services or any part thereof into another program or product without our permission.

  • Using automated scripts to collect information from or interact with the Services.

  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

  • Intimidating, harassing, promoting sexually explicit material, violence, or discrimination based on various factors.

  • Using or attempting to use another person's account, service, or system without authorization.

  • Using the Services in a way that creates a conflict of interest or undermines its purpose, such as engaging in fake reviews.

  • Uploading, transmitting, distributing, or storing malicious or harmful files, such as viruses or logic bombs.

  • Engaging in unsolicited or unauthorized advertising, solicitations, pyramid schemes, or any other prohibited form of solicitation.

  • Sharing private information of third parties without their consent, including addresses, phone numbers, email addresses, or credit card numbers.

  • Posting material that infringes upon copyright, trademark, intellectual property, or privacy rights.

  • Posting defamatory, obscene, offensive, pornographic, hateful, or inflammatory material.

  • Providing instructions or encouraging criminal offenses, dangerous activities, self-harm, or any material intended to harass, harm, distress, or upset people.

  • Threatening others or promoting racism, discrimination, or any form of harm or violence.

  • Providing answers, responses, comments, opinions, analysis, or recommendations without the proper qualifications or licenses.

  • Posting objectionable material that restricts or inhibits others from using the Services or may cause harm or liability.

Furthermore, your use of the Services must always comply with our Platform Guidelines.

We reserve the right to remove or disable access to content at our discretion and without prior notice for any reason. This may include objectionable content, violations of these Terms or our Platform Guidelines, or content that could harm the Services or our users. Our automated systems analyze content, including emails, to provide personally relevant features such as customized search results, tailored advertising, and spam and malware detection. This analysis occurs during the transmission, receipt, and storage of content.

6. Intellectual Property Rights

We respect intellectual property rights and ask you to do the same. As a condition of your access to and use of the Services, you agree to the terms of the Copyright Policy.

7. Content

Intoit Content

Between you and Intoit, the Intoit Content, which includes content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and the overall look and feel of the Services, along with all intellectual property rights related to it, are either owned or licensed by Intoit. However, you or your licensors will own any User Content that you upload or transmit through the Services. Unauthorized use of the Intoit Content or materials on the Services is strictly prohibited. You may not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or exploit the Intoit Content for any purpose without the prior written consent of Intoit or its licensors. All rights not expressly granted in these Terms are reserved by Intoit and its licensors.

By using the Services, you acknowledge and agree that Intoit may generate revenues, increase goodwill, or derive value from your use of the Services, including through the sale of advertising, sponsorships, promotions, and usage data. Unless explicitly permitted by Intoit in these Terms or another agreement, you have no right to share in such revenue, goodwill, or value. You also acknowledge that, unless specifically permitted by Intoit in these Terms or another agreement, you have no right to receive income or consideration from any User Content or your use of musical works, sound recordings, or audiovisual clips available on the Services. You are prohibited from monetizing or obtaining consideration from any User Content within the Services or on any third-party service without Intoit's permission.

Please note that no rights are licensed with respect to sound recordings and the musical works embodied therein that are made available through the Service.

When you view content provided by others on the Services, you do so at your own risk. The content on the Services is for general information purposes only and should not be relied upon as advice. It is recommended to seek professional or specialist advice before taking any action based on the content on our Services.

We make no representations, warranties, or guarantees, whether express or implied, regarding the accuracy, completeness, or timeliness of any Intoit Content, including User Content. The Services may contain links to third-party websites and resources, which are provided for informational purposes only. We have no control over the content of those sites or resources and do not endorse them. We are not obligated to pre-screen, monitor, review, or edit any content posted by users on the Services, including User Content.

User-Generated Content

Users of the Services have the ability to upload, post, transmit, or otherwise share User Content, such as text, photos, videos, sound recordings, and musical works. This includes the option to create collaborative User Content that combines contributions from multiple users. The views expressed by other users do not reflect our views or values.

When you use features that allow you to upload or transmit User Content through the Services or interact with other users, you must adhere to the standards outlined in the "Your Access to and Use of Our Services" section. If you choose to upload or transmit User Content on third-party platforms, you must also comply with their content guidelines and the standards set forth in the aforementioned section. We are not liable for any loss or damage resulting from your breach of the warranty that your User Content complies with these standards.

Any User Content you submit is considered non-confidential and non-proprietary. You should not post or transmit any User Content that you consider confidential or proprietary. By submitting User Content, you confirm that you own the content or have obtained all necessary permissions, clearances, or authorizations from the content owner to submit it to the Services and allow its use on other third-party platforms.

If you only own the rights to a sound recording but not the underlying musical works, you should refrain from posting such recordings unless you have the necessary permissions, clearances, or authorizations from the relevant content owner.

While you retain the copyright to your User Content, by submitting it via the Services, you grant us an unconditional, irrevocable, non-exclusive, royalty-free, fully transferable, perpetual, worldwide license to use, modify, adapt, reproduce, create derivative works of, publish, transmit, distribute, and authorize others to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish, and transmit your User Content in any format and on any platform, now known or invented in the future.

Additionally, you grant us a royalty-free license to use your user name, image, voice, and likeness to identify you as the source of your User Content, subject to potential limitations due to age restrictions.

The granted rights include the reproduction and public performance of sound recordings and the musical works embodied within them, without the obligation to pay royalties to any third party, such as record labels, music publishers, performing rights organizations, or other royalty participants involved in the creation of User Content.

If you are a composer, author, or recording artist affiliated with a PRO or under contract with a record label, you are responsible for notifying your PRO and obtaining the necessary consent to grant the royalty-free licenses described in these Terms.

We have the right to disclose your identity to third parties if they claim that your User Content violates their intellectual property rights or right to privacy.

We reserve the right, at our discretion, to cut, crop, edit, refuse to publish, remove, disallow, block, or delete any User Content. We are not liable for any User Content posted by users or published by authorized third parties.

If you have a complaint about content uploaded by other users, please contact us.

We make reasonable efforts to promptly remove infringing material from our Services. It is our policy to disable or terminate the accounts of users who repeatedly infringe copyrights or intellectual property rights.

We appreciate and consider the feedback we receive from the user community. If you provide Feedback regarding our products, services, or features, you acknowledge that we have no obligation to review, consider, implement, or return the Feedback. You grant us an irrevocable, perpetual, unlimited, and unrestricted license to use, reproduce, distribute, create derivative works of, modify, publicly perform,

8. Indemnity

You agree to defend, indemnify, and hold harmless Intoit, its parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents, and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.

9. EXCLUSION OF WARRANTIES

NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT YOU CANNOT CONTRACTUALLY AGREE TO ALTER OR WAIVE AND ARE LEGALLY ALWAYS ENTITLED TO AS A CONSUMER.

THE SERVICES ARE PROVIDED “AS IS” AND WE MAKE NO WARRANTY OR REPRESENTATION TO YOU WITH RESPECT TO THEM. IN PARTICULAR WE DO NOT REPRESENT OR WARRANT TO YOU THAT:

  • YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS;

  • YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR;

  • ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; AND

  • DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.

NO CONDITIONS, WARRANTIES OR OTHER TERMS (INCLUDING ANY IMPLIED TERMS AS TO SATISFACTORY QUALITY, FITNESS FOR PURPOSE OR CONFORMANCE WITH DESCRIPTION) APPLY TO THE SERVICES EXCEPT TO THE EXTENT THAT THEY ARE EXPRESSLY SET OUT IN THE TERMS. WE MAY CHANGE, SUSPEND, WITHDRAW OR RESTRICT THE AVAILABILITY OF ALL OR ANY PART OF OUR PLATFORM FOR BUSINESS AND OPERATIONAL REASONS AT ANY TIME WITHOUT NOTICE

10. LIMITATION OF LIABILITY

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS AND FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

SUBJECT TO THE PARAGRAPH ABOVE, WE SHALL NOT BE LIABLE TO YOU FOR:

  • (I) ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY);

  • (II) ANY LOSS OF GOODWILL;

  • (III) ANY LOSS OF OPPORTUNITY;

  • (IV) ANY LOSS OF DATA SUFFERED BY YOU; OR

  • (V) ANY INDIRECT OR CONSEQUENTIAL LOSSES WHICH MAY BE INCURRED BY YOU. ANY OTHER LOSS WILL BE LIMITED TO THE AMOUNT PAID BY YOU TO INTOIT WITHIN THE LAST 12 MONTHS.

ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU AS A RESULT OF:

  • ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICE;

  • ANY CHANGES WHICH WE MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);

  • THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;

  • YOUR FAILURE TO PROVIDE US WITH ACCURATE ACCOUNT INFORMATION; OR

  • YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.

PLEASE NOTE THAT WE ONLY PROVIDE OUR PLATFORM FOR DOMESTIC AND PRIVATE USE. YOU AGREE NOT TO USE OUR PLATFORM FOR ANY COMMERCIAL OR BUSINESS PURPOSES, AND WE HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, LOSS OF GOODWILL OR BUSINESS REPUTATION, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

IF DEFECTIVE DIGITAL CONTENT THAT WE HAVE SUPPLIED DAMAGES A DEVICE OR DIGITAL CONTENT BELONGING TO YOU, AND THIS IS CAUSED BY OUR FAILURE TO USE REASONABLE CARE AND SKILL, WE WILL EITHER REPAIR THE DAMAGE OR PAY YOU COMPENSATION. HOWEVER, WE WILL NOT BE LIABLE FOR DAMAGE THAT YOU COULD HAVE AVOIDED BY FOLLOWING OUR ADVICE TO APPLY AN UPDATE OFFERED TO YOU FREE OF CHARGE OR FOR DAMAGE THAT WAS CAUSED BY YOU FAILING TO CORRECTLY FOLLOW INSTALLATION INSTRUCTIONS OR TO HAVE IN PLACE THE MINIMUM SYSTEM REQUIREMENTS ADVISED BY US.

THESE LIMITATIONS ON OUR LIABILITY TO YOU SHALL APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

YOU ARE RESPONSIBLE FOR ANY MOBILE CHARGES THAT MAY APPLY TO YOUR USE OF OUR SERVICE, INCLUDING TEXT MESSAGING AND DATA CHARGES. IF YOU’RE UNSURE WHAT THOSE CHARGES MAY BE, YOU SHOULD ASK YOUR SERVICE PROVIDER BEFORE USING THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY DISPUTE YOU HAVE WITH ANY THIRD PARTY ARISING OUT OF YOUR USE OF THE SERVICES, INCLUDING, BY WAY OF EXAMPLE AND NOT LIMITATION, ANY CARRIER, COPYRIGHT OWNER OR OTHER USER, IS DIRECTLY BETWEEN YOU AND SUCH THIRD PARTY, AND YOU IRREVOCABLY RELEASE US AND OUR AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

11. Other Terms

No Waiver. Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.

Security. We do not guarantee that our Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our Services. You should use your own virus protection software.

Severability. If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms, and the remaining provisions of the Terms will continue to be valid and enforceable.

ARBITRATION AND CLASS ACTION WAIVER. This Section includes an arbitration agreement and an agreement that all claims will be brought only in an individual capacity (and not as a class action or other representative proceeding). Please read it carefully. You may opt out of the arbitration agreement by following the opt out procedure described below.

Informal Process First. You agree that in the event of any dispute between you and Intoit, you will first contact Intoit and make a good faith sustained effort to resolve the dispute before resorting to more formal means of resolution, including without limitation any court action.

Arbitration Agreement. After the informal dispute resolution process, any remaining dispute, controversy, or claim (collectively, “Claim”) relating in any way to your use of Intoit’s services and/or products, including the Services, or relating in any way to the communications between you and Intoit or any other user of the Services, will be finally resolved by binding arbitration. This mandatory arbitration agreement applies equally to you and Intoit. However, this arbitration agreement does not (a) govern any Claim by Intoit for infringement of its intellectual property or access to the Services that is unauthorized or exceeds authorization granted in these Terms or (b) bar you from making use of applicable small claims court procedures in appropriate cases. If you are an individual, you may opt out of this arbitration agreement within thirty (30) days of the first of the date you access or use this Service by following the procedure described below.

You agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision and that you and Intoit are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision will survive any termination of these Terms.

If you wish to begin an arbitration proceeding, after following the informal dispute resolution procedure, you must send a letter requesting arbitration and describing your claim to:

The arbitrator, and not any federal, state, or local court, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, unconscionability, arbitrability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. However, the preceding sentence will not apply to the “Class Action Waiver” section below.

If you do not want to arbitrate disputes with Intoit and you are an individual, you may opt out of this arbitration agreement by sending an email to admin@intoit.info within thirty (30) days of the first of the date you access or use the Services.

Class Action Waiver. Any Claim must be brought in the respective party’s individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding (“Class Action”). The parties expressly waive any ability to maintain any Class Action in any forum. If the Claim is subject to arbitration, the arbitrator will not have the authority to combine or aggregate similar claims or conduct any Class Action nor make an award to any person or entity not a party to the arbitration. Any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator. The parties understand that any right to litigate in court, to have a judge or jury decide their case, or to be a party to a class or representative action, is waived and that any claims must be decided individually, through arbitration.

If this class action waiver is found to be unenforceable, then the entirety of the Arbitration Agreement, if otherwise effective, will be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. If for any reason a claim proceeds in court rather than in arbitration, you and Intoit each waive any right to a jury trial.

If a counter-notice is received by Intoit’s Copyright Agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed content or cease disabling it. Unless the original complaining party files an action seeking a court order against the Content Provider, member, or user, the removed content may be replaced, or access to it restored, in ten business days or more after receipt of the counter-notice at Intiot’s sole discretion.

Please understand that filing a counter-notification may lead to legal proceedings between you and the complaining party to determine ownership. Be aware that there may be adverse legal consequences in your country if you make a false or bad-faith allegation by using this process.

California Consumer Rights Notice. Under California Civil Code Section 1789.3, California users of the Services receive the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at the contact information set forth at https://www.dca.ca.gov/about_us/contactus.shtml.

Users of the Services who are California residents and are under 18 years of age may request and obtain removal of User Content they posted by contacting us. All requests must be labeled "California Removal Request" on the email subject line. All requests must provide a description of the User Content you want removed and information reasonably sufficient to permit us to locate that User Content. We do not accept California Removal Requests via postal mail, telephone or facsimile. We are not responsible for notices that are not labeled or sent properly, and we may not be able to respond if you do not provide adequate information.

Exports. You agree that you will not export or re-export, directly or indirectly the Services and/or other information or materials provided by Intoit hereunder to any country for which the United States or any other relevant jurisdiction requires any export license or other governmental approval at the time of export without first obtaining such license or approval. In particular, but without limitation, the Services may not be exported or re-exported (a) into any U.S. embargoed countries or any country that has been designated by the U.S. Government as a “terrorist supporting” country, or (b) to anyone listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List.

U.S. Government Restricted Rights. The Services and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

App Stores

To the extent permitted by applicable law, the following supplemental terms shall apply when accessing the Platform through specific devices:

Notice regarding Apple.

By downloading the Platform from a device made by Apple, Inc. (“Apple”) or from Apple’s App Store, you specifically acknowledge and agree that:

  • These Terms between Intoit and you; Apple is not a party to these Terms.

  • The license granted to you hereunder is limited to a personal, limited, non-exclusive, non-transferable right to install the Platform on the Apple device(s) authorised by Apple that you own or control for personal, non-commercial use, subject to the Usage Rules set forth in Apple’s App Store Terms of Services.

  • Apple is not responsible for the Platform or the content thereof and has no obligation whatsoever to furnish any maintenance or support services with respect to the Platform.

  • In the event of any failure of the Platform to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Platform, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Platform.

  • Apple is not responsible for addressing any claims by you or a third party relating to the Platform or your possession or use of the Platform, including without limitation (a) product liability claims; (b) any claim that the Platform fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

  • In the event of any third party claim that the Platform or your possession and use of the Platform infringes such third party’s intellectual property rights, Apple is not responsible for the investigation, defence, settlement or discharge of such intellectual property infringement claim.

  • You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary hereof.

  • Intoit expressly authorises use of the Platform by multiple users through the Family Sharing or any similar functionality provided by Apple.

Intoit’s Terms of Service and Community Guidelines do not allow posting, sharing, or sending any content that violates or infringes someone else’s copyrights, trademarks or other intellectual property rights.

Copyright is a legal protection granted to original works, such as music, videos, and other creative expressions. It safeguards the specific way in which an idea is expressed, but not the underlying ideas or facts themselves.

At Intoit, we strictly prohibit the infringement of copyright. Unauthorized use of copyrighted content without proper authorization or a legally valid reason is a violation of our policies.

It is important to note that not all unauthorized uses of copyrighted content constitute infringement. Certain countries have exceptions to copyright infringement, which permit the use of copyrighted works under specific circumstances without authorization. Examples include the fair use doctrine in the United States and permitted acts of fair dealing in the European Union, as well as similar exceptions under local laws in other countries.

If any user content is found to infringe someone else's copyright, it will be removed. Multiple violations of copyright or other breaches of our Terms of Service and Community Guidelines may result in the suspension or termination of the user's account. Additionally, individuals who have engaged in improper activities on Intoit's site, app, or any platform hosted by Intoit may be refused the ability to open a new account.

Contacting the user directly may resolve your complaint more quickly and in a way that is more beneficial to you, the user, and our community. You may also contact us by emailing admin@intoit.info.

All complaints should contain the information requested in our online Copyright Infringement Report form. Failure to include necessary information may limit our ability to investigate your claims and may result in your complaint being denied.

We may provide the account holder with your contact information, including the email address and the name of the copyright owner, and/or details of the complaint.

Before submitting a notification, please be aware that intentionally submitting a misleading or fraudulent report may lead to liability for damages under section 512(f) of the United States Digital Millennium Copyright Act (DMCA) or similar laws as may be applicable in other countries.

If you submit a report or infringement notification to us, we may contact you if we have additional questions about your report or notification. Please note that Intoit is not in a position to adjudicate disputes between third parties, and may not be able to remove the content or suspend the account you reported. As an alternative, you may want to contact the person who posted the content or owns the account to try to resolve your issue directly.

EU Copyright Directive

Pursuant to Article 17 of the Copyright Directive (EU 2019/790), if you want to make an inquiry about granting authorization to Intoit to make your copyright-protected works available on Intoit, please contact us. We will review your request and be in touch.

If you want to request that your music or audiovisual works are made unavailable in the EU, contact us. So that Intoit can consider your request, you will have to provide us with relevant and necessary information about you and your copyright works. Upon receiving this information and validating your request, Intoit will do its best to ensure that your copyright work is made unavailable on Intoit in the EU.

Please note that in accordance with its legal obligations, Intoit provides to users and rightsholders a copyright infringement dispute resolution mechanism; however, rightsholders remain free to assert their rights in court.

Information for Users: Copyright Infringement Counter-Notification

If you are a user located outside of the European Union

If you receive a copyright infringement notification that you believe to be in error or believe that you are authorized to use the content, you can reach out to the copyright owner directly to request a retraction.

You may also contact us. All counter-notification should contain the information requested in the Counter Notification Form. Failure to include necessary information may limit our ability to investigate your claims and may result in your counter-notification being denied.

The counter-notification process will take time to complete; please be patient. During this time, the copyright claimant may file an action seeking a court order to keep the content down pursuant to the United States Digital Millennium Copyright Act (DMCA) or similar laws in other countries. Please note that, where appropriate and authorized by law, we will forward the entire counter-notification to the original reporter, including any contact information you provide, in accordance with our Terms of Services and Privacy Policy. The claimant may use this information to file a lawsuit against you.

If we do not receive notice that the original reporter is seeking a court order to prevent further infringement of the material at issue, we may replace or cease disabling access to the material that was removed if the material does not infringe on third-party copyright. The decision to re-post any material is at Intoit’s sole discretion.

Under EU law, users are allowed to use copyrighted works without the authorization of the copyright holder for quotation, criticism, review, and for the purpose of caricature, parody or pastiche provided that such use is fair. EU countries may also provide for additional exceptions. See below some further information about the exceptions and limitations to copyright available in the EU:

  • Quotation, criticism and review

Quotation is the use of an extract from a copyright-protected work for purposes such as illustrating an assertion, defending an opinion or engaging in debate.   • Caricature, parody and pastiche

Videos that fall within an exception or limitation to copyright are still subject to our Community Guidelines. This means that such videos should not contain hate speech or involve hateful behavior or be used to abuse, mock, humiliate, embarrass, intimidate, or hurt any person.

Please note that in accordance with its legal obligations, Intoit provides users and rightsholders a copyright infringement dispute resolution mechanism; however, users remain free to assert their rights in court.

Trademark

A trademark is a word, symbol, slogan, design, or combination of any of the foregoing that identifies the source of a product or service and distinguishes it from other products or services.

Trademark Infringement

Trademark laws prohibit trademark infringement, which is generally the unauthorized use of a trademark or service mark in connection with goods or services in a way that is likely to cause confusion, deception or mistake about the source, origin, sponsorship or affiliation of the associated goods and/or services.

At the same time, the use of another’s trademark for purposes of accurately referencing, lawfully commenting, criticizing, parodying, or reviewing the trademark owner’s products or services, or for purposes of comparing them to other products or services, where the mark is not used to designate the user’s own goods or services or those of a third party, is generally not considered a violation of our policies. Likewise, it is generally permissible to make a fan page about an artist, even without their permission, provided that you do not claim to speak for or be associated with them or otherwise violate their’s intellectual property rights.

Removal of Content; Suspension or Termination of Account

Any content that violate another’s trademark rights may be taken down. Repeat violations of trademark rights in connection with the use of the Intoit site or app, or other violations of the Terms of Service and Community Guidelines may result in the suspension or termination of the user account. We reserve the right to refuse any account holder whose account was used for improper activities from opening a new account on Intoit’s site or app, or otherwise hosted by Intoit.

Trademark Complaint and Notification

Contacting the user directly may resolve your complaint more quickly and in a way that is more beneficial to you, the user, and our community. You may also contact us.

All complaints should contain the information requested in our online Trademark Infringement Report form. Failure to include necessary information may limit our ability to deal with your claims and may result in your complaint being denied. We may provide the account holder with your contact information, including the email address and the name of the trademark owner, and/or details of the complaint, in accordance with our Terms of Services and Privacy Policy.

Before submitting a notification, please be aware that intentionally submitting a misleading or fraudulent report may lead to liability for damages under laws as may be applicable in some countries.

Trademark Infringement Counter-Notification

If you receive a trademark infringement notification that you believe to be in error or believe that you are authorized to use the content, you can reach out to the trademark owner directly to request a retraction.

You may also contact us. All counter-notification should contain the information requested in our online Counter Notification Form. Failure to include necessary details may limit our ability to investigate your claims and may result in your counter-notification being denied.

Intoit endeavors to cultivate connections and broaden the horizons of its users. Our forthcoming social media platform aims to establish a global community, where individuals can create, share, explore their surroundings, and connect with others worldwide. Upholding a supportive environment for our expanding community is our paramount goal. To achieve this, we have formulated Platform Guidelines that establish a framework of norms and a standard code of conduct, ensuring a safe and inclusive space for all participants.

Safety, diversity, inclusion, and authenticity are the pillars upon which Intoit stands. We encourage creators to embrace their uniqueness while motivating viewers to engage with inspiring content. We firmly believe that a secure environment fosters open self-expression. Additionally, we value the global nature of our community and strive to respect the diverse cultural norms within the regions we operate. Authenticity is a key aspect that we seek to foster, promoting genuine interactions and authentic content on Intoit.

Our Platform Guidelines are applicable to all users and activities within Intoit. Proactive enforcement of these guidelines is achieved through a combination of technological solutions and human moderation, with the objective of addressing potential violations before they are reported. Furthermore, we encourage community members to utilize the reporting tools provided by Intoit to notify us of any content or accounts believed to be in breach of our Platform Guidelines.

Any content that infringes upon our Platform Guidelines, encompassing audio, images, comments, links, or textual materials, will be expeditiously removed. Individuals affected by these decisions will be duly informed and given the opportunity to appeal if they believe no violation has occurred. In cases of severe or repeated on-platform violations, we reserve the right to temporarily or permanently suspend accounts and/or users involved. We may also take into consideration actions on other platforms and offline behavior when making such determinations. In circumstances where there is a specific, credible, and imminent threat to human life, we may report such incidents to law enforcement authorities. Intoit is intended for individuals aged 13 and above, and we actively take measures to remove accounts suspected of being below this age threshold. Our algorithms are thoughtfully designed to prioritize trust and safety. Therefore, for certain types of content, we may reduce discoverability, such as by redirecting search results or excluding videos from recommendations in the For You feed. More detailed information on content eligibility for the For You feed can be found in the corresponding section below.

Simultaneously, we acknowledge that certain content, which would typically be removed in accordance with our Platform Guidelines, may be of public interest. Consequently, we may grant exceptions under specific limited circumstances, including educational, documentary, scientific, artistic, or satirical content, as well as content set within fictional or professional contexts, counterspeech, or content that facilitates individual expression on socially significant topics. To mitigate any potential negative impact of explicit content, we may introduce safety measures, such as an "opt-in" screen or warning.

In line with our commitment to maintaining a secure environment, we periodically update our Platform Guidelines in consultation with relevant stakeholders. These updates allow us to adapt to evolving behaviors and risks, ensuring that Intoit remains a safe and welcoming platform for all users.

 

Minor Safety:

Protecting the safety of minors is of utmost importance to us on our platform. At Intoit, we define a minor as an individual under the age of 18. We strictly prohibit any activities that contribute to the abuse, harm, endangerment, or exploitation of minors. This includes the depiction of abuse, exploitation, or endangerment of minors through content, including animation or digitally created or manipulated media. Such content violates our platform guidelines and will be promptly removed once detected. In instances involving child sexual abuse material (CSAM), we report the material and supporting evidence to the National Center for Missing & Exploited Children (NCMEC) as well as any other relevant legal authorities.

To ensure the safety of our users, we enforce the minimum age requirement as stated in our Terms of Service. If an account is identified as belonging to an underage individual, it will be removed from our platform. Considering our platform's focus on ensuring the safety of minors, certain features are restricted based on age. Users under the age of 16 are unable to utilize direct messaging, and their content is ineligible to appear in the For You feed.

Grooming Behavior:

Grooming behavior involves an adult establishing an emotional relationship with a minor to gain their trust for the purpose of future or ongoing sexual contact, sexual abuse, trafficking, or exploitation. Such behaviors may include flattery, requests for contact on or off-platform, solicitation of personal information, solicitation of child sexual abuse material, sexual solicitations or comments, and gift-giving.

The following actions are strictly prohibited on our platform:

  • Posting, uploading, or sharing grooming advances

  • Depicting, promoting, normalizing, or glorifying grooming behaviors through content

  • Soliciting real-world contact between a minor and an adult or between minors with a significant age difference

  • Displaying or offering nudity to minors

  • Soliciting minors to connect with an adult on another platform, website, or digital space

  • Any solicitation of nude imagery or sexual contact, through coercion or blackmail

Nudity and Sexual Activity Involving Minors:

Nudity and sexual activity involving minors encompass content that explicitly reveals breasts, genitals, anus, or buttocks, or mimics, implies, or displays sexual acts involving minors. We strictly prohibit the depiction of nudity or sexual activity, including digitally created or manipulated content, involving minors.

The following actions are strictly prohibited on our platform:

  • Posting, uploading, streaming, or sharing content depicting or implying minor sexual activities, including penetrative and non-penetrative sex, oral sex, or intimate kissing

  • Depicting sexual arousal or sexual stimulation involving a minor

  • Depicting a sexual fetish involving a minor

  • Depicting exposed genitals, buttocks, pubic region, or female nipples of a minor

  • Including sexually explicit language that depicts or describes a minor

  • Depicting a minor with sexually explicit song lyrics

  • Depicting sexually explicit dancing by a minor, including twerking, breast shaking, pelvic thrusting, or fondling of the groin or breasts of oneself or another

  • Depicting a minor undressing

  • Depicting a minor in minimal clothing that lacks situational relevance to the location

  • Making sexualized comments, using emojis, text, or other graphics to imply or veil nudity or sexual activity involving a minor

Harmful Activities by Minors:

Harmful activities by minors include the possession or consumption of substances prohibited for minors, misuse of legal substances, engagement in illegal activities, and participation in activities, physical challenges, or dares that may endanger their well-being. Such content will be removed from our platform.

The following actions are strictly prohibited on our platform:

  • Posting, uploading, streaming, or sharing content that suggests, depicts, imitates, or promotes the possession or consumption of alcoholic beverages, tobacco, or drugs by a minor

  • Offering instruction targeting minors on how to buy, sell, or trade alcohol, tobacco, or controlled substances

  • Depicting or promoting activities that may jeopardize youth well-being, including physical challenges, dares, or stunts

Physical and Psychological Harm of Minors:

Behaviors that put minors at risk of physical or psychological harm, including physical abuse, neglect, child endangerment, and psychological disparagement, are strictly prohibited on our platform. Such content will be removed.

The following actions are strictly prohibited on our platform:

  • Posting, uploading, streaming, or sharing content that depicts or promotes physical abuse, neglect, endangerment, or psychological disparagement of minors

Crimes Against Children:

Users who have been convicted of crimes against children are not permitted to have an account on our platform. These crimes include sexual assault, molestation, murder, physical abuse or neglect, abduction, international parental kidnapping, trafficking, exploitation of minors for prostitution, live online sexual abuse of a minor, sexual exploitation of minors in the context of travel and tourism, attempts to obtain or distribute child sexual abuse material (CSAM), and the production, possession, or distribution of CSAM. If we discover any users involved in such crimes, their accounts will be banned. Any self-disclosed user information indicating that the account holder is a pedophile or minor sex offender will be taken at face value, and the account will be deleted.

Dangerous Acts and Challenges:

We do not permit users to share content that portrays, promotes, normalizes, or glorifies dangerous acts that may result in severe injury or death. This includes activities conducted outside of a professional context or without the necessary skills and safety precautions. Examples of prohibited content include the inappropriate use of dangerous tools or objects, depictions of dangerous driving behavior, ingestion of harmful substances, and detailed instructions on performing dangerous activities. Additionally, we do not allow the dissemination of dangerous games, dares, challenges, or stunts that pose a risk of injury or property damage.

Suicide, Self-Harm, and Disordered Eating:

We are deeply concerned about the well-being of our community members and, therefore, do not permit content that portrays, promotes, normalizes, or glorifies activities that could lead to suicide, self-harm, or disordered eating. However, we do support individuals in sharing their personal experiences in a safe manner to raise awareness and find support within the community. If we become aware of a user who may be at risk of self-harm, we may take appropriate action, such as alerting local emergency services. Content that encourages or provides instructions for suicide or self-harm, as well as suicide or self-harm games, dares, challenges, pacts, or hoaxes, is strictly prohibited. Similarly, content that promotes unhealthy eating behaviors or provides tips related to disordered eating is not allowed.

Adult Nudity and Sexual Activities:

To maintain a welcoming and safe platform, we have strict policies against nudity, pornography, and sexually explicit content. This includes content that depicts or supports non-consensual sexual acts, the sharing of non-consensual intimate imagery, and adult sexual solicitation. We also prohibit any form of content that promotes or normalizes sexual exploitation, which involves abusing a position of vulnerability, power, or trust for sexual purposes. This encompasses content that depicts or promotes non-consensual sexual acts, non-consensual sharing of intimate imagery, sexual violence, or sexual solicitation.

Bullying and Harassment:

We strongly believe in fostering an inclusive community where individuals can express themselves without fear of abuse. Therefore, we do not tolerate any form of shaming, bullying, or harassment within our platform. This includes expressions of abuse such as threats, degrading statements, mocking, humiliation, embarrassment, intimidation, or intentional harm directed at an individual. While critical comments about public figures may be allowed in discussions of public interest, engaging in serious abusive behavior towards public figures is prohibited.

Sexual Harassment:

Sexual harassment involves unwelcome or inappropriate sexual behavior targeted at another individual. We strictly prohibit content that glorifies, normalizes, or promotes sexual harassment, regardless of the user's intent. This includes attempts to make unwanted sexual contact, disparagement of another person's sexual activity, simulation of sexual activity with another person (including through text or the use of in-app features), or morphing an individual's image to imply sexual suggestiveness or engagement in sexual activity without their consent. It also includes revealing or threatening to reveal an individual's private sexual life or sexual orientation without consent.

Threats of Hacking, Doxxing, and Blackmail:

Threatening to hack, dox, or blackmail others with the intention to harass or exploit them is considered abusive behavior and is strictly prohibited on our platform. Doxxing refers to the act of collecting and publishing personal data or personally identifiable information (PII) for malicious purposes. We consider these online behaviors forms of abuse that can cause serious emotional distress and offline harm. Thus, we do not allow content that threatens to reveal personal data or PII, incites or encourages others to hack or disclose personal information, or uses an individual's account or personal data to encourage abuse, trolling, or harassment.

Hateful behavior

Intoit is a diverse and inclusive community that has no tolerance for discrimination. We do not permit content that contains hate speech or involves hateful behavior, and we remove it from our platform. We ban accounts and/or users that engage in severe or multiple hate speech violations or that are associated with hate speech off the Intoit platform.

Attacks and slurs on the basis of protected attributes

We define hate speech or behavior as content that attacks, threatens, incites violence against, or otherwise dehumanizes an individual or a group on the basis of the following protected attributes:

  • Race

  • Ethnicity

  • National origin

  • Religion

  • Caste

  • Sexual orientation

  • Sex

  • Gender

  • Gender identity

  • Serious disease

  • Disability

  • Immigration status

Slurs are defined as derogatory terms that are intended to disparage groups or individuals based on any protected attributes listed above. To minimize the spread of egregiously offensive terms, we remove all slurs from our platform, unless the terms are reappropriated, used self-referentially (i.e., by members of the protected group), or used in a way that does not disparage (e.g., educational context).

Do not post, upload, stream, or share:

  • Content claiming individuals or groups with protected attributes are physically, mentally, or morally inferior or referring to them as criminals, animals, inanimate objects, or other non-human entities  

  • Content promoting or justifying violence, exclusion, segregation, or discrimination against them

  • Content that includes the use of non-self-referential slurs

  • Content that targets transgender or non-binary individuals through misgendering or deadnaming

  • Content that depicts harm inflicted upon an individual or a group on the basis of a protected attribute

Hateful ideology

Hateful ideologies are those that demonstrate clear hostility toward people because of their protected attributes. Hateful ideologies are incompatible with the inclusive and supportive community that our platform provides and we remove content that promotes them.

Do not post, upload, stream, or share:

  • Content that praises, promotes, glorifies, or supports any hateful ideology (e.g., white supremacy, misogyny, anti-LGBTQ, antisemitism)

  • Content that contains names, symbols, logos, flags, slogans, uniforms, gestures, salutes, illustrations, portraits, songs, music, lyrics, or other objects related to a hateful ideology

  • Content that promotes, supports, or advertises conversion therapy or related program

  • Content that denies well-documented and violent events have taken place affecting groups with protected attributes (e.g., Holocaust denial)

  • Claims of supremacy over a group of people with reference to other protected attributes

  • Conspiracy theories used to justify hateful ideologies

 

Violent Extremism:

We have a strong stance against violence, both on and off the Intoit platform. It is strictly prohibited to use our platform for threatening, inciting, or promoting violence, as well as endorsing violent extremist individuals, organizations, or acts. Accounts that promote or glorify off-platform violence or pose a threat to public safety will be banned. When necessary, we will report threats to the appropriate legal authorities. To ensure the safety of our community, we may investigate off-platform behavior to identify and ban accounts associated with violent extremist individuals or organizations.

Threats and Incitement to Violence:

Incitement to violence includes advocating, directing, or encouraging others to commit acts of violence. We do not tolerate threats of violence or incitement to violence on our platform, as they can result in serious physical harm.

The following content is not allowed on our platform:

  1. Statements expressing intent to cause physical harm to individuals or groups.

  2. Statements or imagery encouraging or advocating for violence.

  3. Conditional or aspirational statements that encourage others to commit violence.

  4. Calls to bring weapons to a location with the intention to intimidate or threaten individuals or groups.

  5. Instructions on making or using weapons that may incite violence.

Violent Extremist Organizations and Individuals:

We do not permit organizations or individuals on our platform who promote or engage in violence, including terrorist organizations, organized hate groups, criminal organizations, and non-state armed groups targeting civilians.

Terrorist organizations are non-state actors that employ or threaten violence to achieve political, religious, ethnic, or ideological objectives. Organized hate groups are individuals or organizations that attack others based on protected attributes, such as race, ethnicity, religion, or sexual orientation. Criminal organizations engage in serious crimes like violence, trafficking, kidnapping, and cybercrime.

The following content is not allowed on our platform:
  1. Content praising, promoting, glorifying, or supporting violent acts or extremist organizations or individuals.

  2. Content encouraging participation in or recruiting for violent extremist organizations.

  3. Content featuring names, symbols, logos, flags, slogans, uniforms, gestures, salutes, illustrations, portraits, songs, music, lyrics, or other representations associated with violent extremist organizations or individuals.

Integrity and Authenticity:

We consider trust to be fundamental in our community. To maintain integrity and authenticity, we remove content or accounts that engage in spam or fake engagement, impersonation, or the dissemination of misleading information causing significant harm.

Spam and Fake Engagement:

Fake engagement involves any activity or content that artificially inflates popularity on the platform. We strictly prohibit attempts to manipulate the platform for increased interaction metrics.

The following activities are not allowed:

  1. Sharing instructions on artificially increasing views, likes, followers, shares, or comments.

  2. Buying or selling views, likes, followers, shares, or comments.

  3. Promoting services that generate artificial traffic.

  4. Operating multiple Intoit accounts under false pretenses to distribute commercial spam.

  5. Creating malicious software or modifying code to artificially boost views, likes, followers, shares, or comments.

Impersonation:

Accounts that impersonate others in a deceptive manner are not allowed. When impersonation is confirmed, the account may be asked to revise its profile or banned. Parody, commentary, or fan-based accounts that clearly indicate they are not affiliated with the subject may be permitted.

The following actions are prohibited:

  1. Pretending to be another person or entity by using their name, details, or profile picture in a misleading manner.

Harmful Misinformation:

Misinformation refers to inaccurate or false content. We remove misinformation that causes significant harm to individuals, the community, or the public, irrespective of intent. This includes misinformation that causes physical harm, psychological trauma, property damage, or undermines public trust in civic institutions, governments, elections, or scientific bodies. Inaccurate information, myths, and commercial or reputational harm are not included.

The following content is not allowed:

  1. Misinformation inciting hate or prejudice.

  2. Misinformation related to emergencies inducing panic.

  3. Medical misinformation posing harm to physical health.

  4. Content misleading community members about elections or civic processes.

  5. Conspiratorial content attacking individuals or protected groups, issuing violent calls to action, or denying violent or tragic events.

  6. Digital forgeries (synthetic or manipulated media) distorting the truth and causing significant harm to subjects, individuals, or society.

Illegal Activities and Regulated Goods:

We strive to ensure Intoit does not facilitate activities that violate laws or regulations. The trade, sale, promotion, or use of certain regulated goods is prohibited, as well as the promotion or facilitation of criminal activities, including human exploitation. Content related to regulated or illegal activities in the majority of regions or globally may be removed.

Criminal Activities:

Criminal activities encompass a range of unlawful acts, such as theft, assault, human exploitation, and counterfeiting. We remove content that promotes or enables criminal activities to prevent their normalization, imitation, or facilitation.

The following content is not allowed:

  1. Content promoting physical harm like assault or kidnapping.

  2. Content endangering the safety of others, including swatting.

  3. Content promoting human exploitation, such as smuggling, bonded labor, sex trafficking, or prostitution.

  4. Content promoting vandalism or property damage.

  5. Content promoting poaching or the illegal trade of wildlife.

  6. Content offering the purchase, sale, trade, or solicitation of unlawfully acquired or counterfeit goods.

  7. Content providing instructions on conducting criminal activities causing harm to people, animals, or property.

Weapons:

Depicting, promoting, or trading firearms, ammunition, firearm accessories, or explosive weapons is not allowed. Instructions on manufacturing such weapons are also prohibited. However, exceptions may be made for educational contexts, authorized government personnel, or safe and controlled environments.

The following content is not allowed:

  1. Content displaying firearms, firearm accessories, ammunition, or explosive weapons.

  2. Content offering the purchase, sale, trade, or solicitation of firearms, accessories, ammunition, explosive weapons, or instructions for their production.

Drugs, Controlled Substances, Alcohol, and Tobacco:

Depicting, promoting, or trading drugs, controlled substances, tobacco, or alcohol is not allowed on the platform.

The following content is not allowed:

  1. Content depicting or promoting drugs, drug consumption, or encouraging others to make, use, or trade drugs or controlled substances.

  2. Content offering the purchase, sale, trade, or solicitation of drugs or controlled substances, alcohol, or tobacco products.

  3. Content providing information on buying illegal or controlled substances.

  4. Content depicting or promoting the misuse of legal substances or instructing how to make homemade substances to induce intoxication.

Frauds and Scams:

Exploiting the platform to deceive users and cause financial or personal harm is strictly prohibited. Content that misleads people to gain an unlawful advantage, such as schemes to defraud or steal assets, will be removed.

The following content is not allowed:

  1. Content promoting phishing.

  2. Content promoting Ponzi, multi-level marketing, or pyramid schemes.

  3. Content promoting investment schemes promising high returns or other types of scams.

Gambling:

Content promoting gambling services or resembling advertisements for casinos, sports betting, or any other commercial gambling activities is not permitted.

The following content is not allowed:

  1. Content promoting casinos, sports betting, poker, lotteries, gambling-related software or apps, or other gambling services.

Privacy, personal data, and personally identifiable information (PII)

We do not allow content that violates the confidentiality of personal data or personally identifiable information (e.g., social security information, phone numbers, physical addresses). We remove content that depicts personal data or personally identifiable information (PII) from the platform.

Do not post, upload, stream, or share:

  • Content that contains personal data or personally identifiable information (PII) 

 

Violent and graphic content

Intoit is a platform that celebrates creativity but not violence. We do not allow content that is gratuitously shocking, graphic, sadistic, or gruesome or that promotes, normalizes, or glorifies extreme violence or suffering on our platform. When it is a threat to public safety, we ban the account and, when warranted, we will report it to relevant legal authorities.

Do not post, upload, stream, or share:

  • Content of humans that depicts:

    • violent or graphic deaths or accidents

    • dismembered, mutilated, charred, or burned human remains

    • gore in which an open wound or injury is the core focus

    • real-world physical violence, fighting, or torture

  • Content of animals that depicts: 

    • the slaughter or other non-natural death of animals

    • dismembered, mutilated, charred, or burned animal remains

    • animal cruelty and gore

 

Copyright and trademark infringement

Copyright is a legal right that protects original works of authorship (e.g., music, videos) and original expression of an idea (e.g., the specific way a video or music is expressed or created), although it does not protect underlying ideas or facts. A trademark is a word, symbol, slogan, or design that identifies and distinguishes the source of a product or service. We encourage everyone to create and share original content. Content that infringes on someone else's intellectual property rights is prohibited on our platform and will be removed if we become aware of it. The use of copyrighted work under certain circumstances, such as the fair use doctrine or other applicable laws, or the use of a trademark to reference, lawfully comment, criticize, parody, make a fan page, or review a product or service, may not be considered a violation of our policies.

Do not post, upload, stream, or share:

  • Content that violates or infringes someone else's copyrights, trademarks, or other intellectual property rights

 

Platform security

A top priority for Intoit is the safety and security of our users, creators, business partners, vendors, and employee data, including their personal information, accounts, profiles, content, and other proprietary information, as well as our product and services. We do not allow access to the Intoit platform -- which includes our website, app, network, and associated infrastructure or networks -- through unauthorized methods or to obtain sensitive, confidential, commercial, or personal information. Any attempt to undermine or abuse the security, integrity, or reliability of our platform, products, or services is expressly prohibited.

Do not:

  • Attempt to access the Intoit platform in an unauthorized manner, and do not create fake or misleading versions of the Intoit platform

  • Create or distribute malicious files, content, or messages that contain viruses, Trojan horses, worms, logic bombs, or other materials that may be harmful to the community or platform

  • Use automated scripts, web crawling, software, deceptive techniques, or any other way to attempt to obtain, acquire, or request login credentials or other sensitive information, including non-public data, from Intoit or its users

  • Leverage Intoit accounts under false or fraudulent pretenses to distribute spam, phishing, or smishing content in an attempt to perpetrate cybercrime or gain unauthorized access to others’ content, accounts, systems, or data

  • Modify, adapt, translate, reverse engineer, disassemble, decompile, or create any derivative products based on Intoit, including any files, tables or documentation, or attempt to regenerate any source code, algorithms, methods, or techniques embodied in Intoit

  • Provide access to your account credentials to others or enable others to conduct activities against our Community Guidelines

  • Click on suspicious links or engage in requests for information about your Intoit account details, passwords, verification qualification, financial, or other personal information

 

Ineligible for the Explore Page

The goal of the Explore Page is to provide original content that honors our mission of inspiring creativity and bringing joy to our diverse community around the world. Each account holder’s Explore Page is based on a personalized recommendation system. Our recommendation system is designed with user safety as a primary consideration, meaning that some content may not be eligible for a recommendation. While the spontaneity of the Explore is what makes Intoit unique, the Explore Page is intended for a general audience that includes everyone from our teenage users to great-grandparents. We consider the breadth of our audience when we determine what content is eligible for algorithmic promotion on the platform. Provided it does not violate local laws, the following types of content may be allowed on our platform, searchable, and viewed in the Following feeds but not eligible for a recommendation.

Minor safety

Minors’ sense of judgment and identity mature as they develop. To provide teens with additional room for identity exploration and expression in digital spaces, content uploaded by users under the age of 16 is not eligible for a recommendation. 

Spam, inauthentic, or misleading content

We value authenticity and accuracy. We make ineligible for the Discover Page any content that tricks or manipulates users in order to inauthentically increase followers, likes, views, or other engagement metrics on the platform, including follow-to-follow, like-to-like, and misleading or manipulating users into clicking like or share buttons. Conspiratorial content that counters generally accepted beliefs and casts blame on a group or entity (rather than any living individual) or that includes potentially misleading and harmful content about current, unfolding events where details are still developing, are also ineligible for recommendation.
